“Earnix” is committed to protecting the privacy of its job applicants. This Privacy Policy (“Privacy Policy“) has been created to inform you about how we (including Earnix subsidiaries and affiliates) (collectively, the “Company” or “We”) manage, collect, store and use Personal Information provided in connection with your job application. “Personal Information” means any information that can be used, alone or together with other data, to uniquely identify you and/or any information deemed as personally identifiable information by applicable privacy laws. If you are hired, your applicant information will become a part of your employment record and subject to privacy policies applicable to employees.

We do not sell your information to third parties.

Our Privacy Policy aims to describe:

1. INFORMATION COLLECTED

We collect several types of information from and about you, that can result from various sources – information that you provide to us, information that we receive from third parties and information we collect automatically from our website.  

The information we collect may include without limitation: information provided in your application, in your resume, or otherwise in connection with an application for employment, such as your contact information (name, address, telephone number, and email address), educational and employment background, qualifications, certifications, professional associations, references, compensation requests, and in the event you choose to provide it, your date of birth, gender or gender expression, nationality and/or race. Email correspondences between you, the Company and between the Company and other sources (such as recruiting agency and referrals) about your candidacy, information from references, events in the lifecycle of your candidacy, your responses to questionnaires sent to you by us, information about your candidacy and employment options (such as availability to be hired and salary expectations), evaluations of your candidacy, internal discussions within the Company about your candidacy, materials you or other parties (such as evaluators or background check providers) submitted in relation to your candidacy. We also collect certain information automatically, if and when you interact with our website, including our careers page, or the third-party recruiting tools we use, we, or our service providers, automatically collect information about your use of such website or tools via cookies and other similar tracking technologies. We may collect information about your computer, phone, tablet, or other devices you use to access our website. For more information, please review our cookie preferences information and our cookie policy or the cookie policy of the third-party service provider, as applicable. If you submit your candidacy by email, or online, then you are the main source of the Personal Information. Your Personal Information can also originate from other sources, such as LinkedIn profile, recruitment agencies, headhunters and/or referrals.

2. USE OF INFORMATION

We use the Personal Information we collect to evaluate your candidacy for positions offered by us and for recruitment and human resources management purposes like:

  • processing and evaluating applications,

  • scheduling interviews and managing the recruitment process,

  • assessing your qualifications, skills, or interests against available positions

  • verifying information in your application,

  • making hiring decisions,

  • responding to your questions or inquiries,

  • analyzing, managing, and improving our recruiting and hiring processes,

  • carrying out obligations or administering benefit plans or compensation plans,

  • carrying out administrative purposes, aggregate management reporting, internal training, or as generally required to conduct our business,

  • responding to government requests or court orders, or

  • providing, supporting, or otherwise managing our career website or career portal.

The lawful bases we rely on for processing Personal Information are (if applicable to us under privacy law):

i.  You gave us your consent to the processing of your Personal Information;

ii.  Processing is necessary for the purposes of our legitimate interest; and/or

iii. Processing is necessary for compliance with a legal obligation to which we, as the controller of the information, are subject.

Sub-sections (ii) and (iii) will apply If you are a resident of Switzerland, the United Kingdom, or the European Economic Area (“EEA”).

 

3. THIRD PARTIES WHO PROCESS YOUR INFORMATION

We may disclose your Personal Information to the following categories of recipients:

  • Our subsidiaries and affiliates, as Earnix is part of a wider group of entities.

  • Service providers to help us process applicant and employment information, e.g Comeet, as a recruiting and applicant tracking platform, in order to process your Personal Information as a candidate.

  • Our advisors or legal services providers,

  • A potential buyer or investor in connection with a merger, acquisition, or other sale or transfer,

  • Any other third-party with your consent,

  • Governmental authorities where legally required.

We require our service providers to protect the information they receive with appropriate security measures.

4. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION

Based on your residency and your eligibility in accordance with applicable privacy laws, you may be afforded specific rights regarding your personal information. These rights may include:

  • The right to access your information. In some circumstances, you have the right to object to our processing of your Personal Data and can ask us to restrict our use of your Personal Data and to delete it.  You may also have the right to ask us to correct your Personal Data if it is inaccurate and, to ask us to transfer Personal Data you have provided, to withdraw consent you have given us to use your Personal Data and to ask us not to use automated decision-making which will affect you (as and if applicable).

  • We would like to make you aware that your rights do not always apply in all cases, for example we might not be able to delete your Personal Data if we need it to provide our Service or we are required to keep it by law. We also might not be able to provide you with Personal Data if it would infringe someone else’s rights. We will always try to help you with your request and will let you know in our correspondence with you how we will be able to meet your request and explain why if we are unable to do so. 

  • If you wish to exercise your rights under any applicable law, including the EU General Data Protection Regulation (GDPR) or the California Privacy Act (CCPA) – please contact us by email at privacy@earnix.com. Please note that once you contact us by e-mail regarding your data subject rights, we may require additional information and documents, including certain Personal Data, in order to authenticate and validate your identity and to process your request. Such additional data will be then retained by us for legal purposes (e.g., as proof of the identity of the person submitting the request), in accordance with Section 3 above.

  • If you are a European Union (the “EU”) resident or reside within the European Economic Area (the “EEA”) you also have the right to lodge a complaint with a supervisory authority established by a Member State to protect the fundamental rights and freedoms of natural persons in relation to the processing of Personal Data within the European Union.

  • If you reside in the U.S.A, please read below with respect to the California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), the Virginia Consumer Data Protection Act (VCDPA), and the Colorado Privacy Act (CPA)) rights you might have:

Right to Limit Use and Disclosure of Sensitive Personal Data

You have the right to request that we limit our use or disclosure of your “sensitive personal information” to the extent collected from you. We may deny your limitation request if the use and/or disclosure of the information is necessary for us to perform our Service or provide the goods or services as reasonably expected by an average consumer.

You have the right to not be discriminated by Us because You exercised any of your rights under the CCPA.

Right to designate an authorized agent to submit CCPA requests on your behalf

You may designate an authorized agent to make a request under the CCPA on your behalf. To do so, you need to provide the authorized agent written permission to do so and the agent will need to submit to us proof that such agent has been authorized by you. We will also require that you verify your own identity, as explained below.

5. DATA RETENTION AND SECURITY

(I)    Retention. We will retain your Personal Information for as long as we need it to assess you as a candidate or as long as we have a valid legal basis. In accordance with our internal data retention policies and practices, we can decide whether to keep your personal data, delete it or pseudonymize/anonymize it.

(II)   Security. We implement industry standard measures to reduce the risks of damage, loss, unauthorized access, or use, of your personal data. However, these measures do not provide absolute information security.

6. MINORS

We do not intend to collect Personal Information of children. If you have a reason to suspect that children data is collected, you are kindly requested to immediately report it to us. If you have questions regarding children’s Personal Information, please contact us.

7. INTERNATIONAL DATA TRANSFERS

Please note that we host your Personal Information in connection with your candidacy either in the EEA, in the US, in the country where we are located, or in countries deemed as providing an adequate level of data protection.

Your data will be accessible in the country where We or our service providers are located, the UK, the US, and countries deemed as providing an adequate level of data protection.

We may make changes to this Applicant Privacy Policy. We reserve the right to update or modify this Applicant Privacy Policy at any time and from time to time.
